1. Introduction

Welcome to Jawaiz, a loyalty program aggregator designed to connect users with participating restaurants. By accessing or using the platform, you agree to these Terms of Service (“Terms”). If you do not agree with these Terms, you must stop using the platform immediately. These Terms constitute a binding legal agreement between you (the “User”) and Jawaiz.

2. Definitions

  • Platform: The Jawaiz mobile application, website, and all associated services provided by Jawaiz.

  • User: Any individual or entity using the platform to interact with restaurant loyalty programs.

  • Participating Restaurants: Restaurants that subscribe to offer loyalty programs through Jawaiz.

  • Content: All text, graphics, images, software, and other materials available on the platform.

3. User Responsibilities

  • Account Information: Users must provide accurate information during registration and maintain the confidentiality of their account credentials. Any activity conducted through your account is your responsibility. Users must promptly notify Jawaiz of any unauthorized use of their account.

  • Compliance: Users must adhere to all applicable laws, these Terms, and any guidelines provided by Jawaiz. Users agree not to use the platform for any illegal purposes, including but not limited to fraud or unauthorized access to accounts.

  • Device Security: Users are responsible for ensuring that the devices they use to access the platform are secure and free from malware.

4. Platform Services

  • Intermediary Role: Jawaiz acts solely as an intermediary to connect users with participating restaurants. We do not directly manage or fulfill any loyalty rewards, and our role is limited to facilitating the interaction between users and restaurants.

  • Loyalty Programs: Loyalty programs, including points and rewards, are managed by the respective restaurants. Jawaiz does not guarantee the fulfillment of any loyalty rewards and is not liable for any discrepancies. Restaurants are solely responsible for ensuring that loyalty programs are honored as advertised.

  • Service Availability: Jawaiz aims to ensure the platform is available at all times but does not guarantee uninterrupted access. We may need to suspend or restrict access to carry out maintenance or address technical issues.

5. Limitation of Liability

  • Third-Party Actions: Jawaiz is not liable for the actions, omissions, or failures of participating restaurants, including the non-fulfillment of loyalty rewards. Any issues regarding loyalty rewards must be addressed directly with the restaurant.

  • Complaint Mechanism: Users may report issues through the in-app chat feature. While Jawaiz will make reasonable efforts to facilitate a resolution, we hold no financial or legal responsibility for disputes between users and restaurants. Jawaiz’s role is limited to facilitating communication between the parties.

  • No Warranty: The platform is provided “as is” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by UAE law.

  • Platform Use: Jawaiz is not responsible for any losses, damages, or inconvenience resulting from the unavailability or malfunction of the platform, including but not limited to data loss or unauthorized

6. User Conduct

  • Prohibited Activities: Users must not engage in any activities that could harm or negatively impact the platform, including but not limited to: hacking, unauthorized access, exploiting vulnerabilities, distributing malware, reverse engineering, scraping data, or any actions that could interfere with the proper functioning of the platform. Users are also prohibited from using the platform to harass, abuse, or threaten other users or participating restaurants.

  • Termination: Jawaiz reserves the right to suspend or terminate user accounts for violations of these Terms or any misuse of the platform, including any actions that threaten the integrity of the platform or the safety of other users. Jawaiz also reserves the right to take any legal action deemed necessary.

7. Intellectual Property

  • Ownership: All intellectual property rights related to the platform, including software, design, logos, content, and proprietary information, are owned by Jawaiz or its licensors. Unauthorized use of any intellectual property is strictly prohibited.

  • Usage Rights: Users are granted a limited, non-exclusive, non-transferable license to use the platform in accordance with these Terms. This license is revocable at any time at the discretion of Jawaiz.

8. Governing Law and Disputes

  • Applicable Law: These Terms are governed by the laws of the United Arab Emirates (UAE).

  • Dispute Resolution: Any disputes arising from these Terms or the use of the platform will first be resolved through negotiation or mediation. If unresolved, the dispute will be settled in accordance with UAE arbitration rules. Users agree to submit to the exclusive jurisdiction of the courts of the UAE for the resolution of any disputes.

9. Amendments

  • Right to Modify: Jawaiz reserves the right to amend these Terms at any time. Significant changes will be communicated to users via the platform or by other reasonable means. It is the user’s responsibility to review these Terms periodically.

  • Continued Use: Your continued use of the platform after amendments constitutes acceptance of the revised Terms.

10. Indemnification

  • User Indemnification: Users agree to indemnify and hold harmless Jawaiz, its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from or related to their use of the platform, violation of these Terms, or infringement of any rights of third parties. This includes, but is not limited to, damages arising from misuse of the platform, violation of applicable laws, or any disputes between users and participating restaurants.

12. Miscellaneous

  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remainder of the Terms will remain in effect. Any invalid or unenforceable provision will be modified to reflect the intent of the original provision as closely as possible.

  • Entire Agreement: These Terms constitute the entire agreement between the user and Jawaiz regarding the use of the platform, superseding any prior agreements or communications.

  • No Waiver: Failure by Jawaiz to enforce any provision of these Terms shall not be construed as a waiver of any rights.
